Overview

The Bankruptcy Specialist is responsible for supporting the management of bankruptcy accounts, ensuring compliance with all relevant bankruptcy laws and regulations. This role involves preparing and filing necessary legal documents, serving as the primary point of contact for bankruptcy trustees, attorneys, and courts. The Bankruptcy Specialist will provide guidance and support to the collections team on bankruptcy-related matters and collaborate with external legal counsel to handle complex cases. This role will play a critical role in minimizing financial losses and protecting the credit union’s interests during bankruptcy proceedings. The ideal candidate will stay updated on changes in bankruptcy laws and regulations to ensure ongoing compliance and assist in the development and implementation of related policies and procedures. The ideal candidate must have familiarity with bankruptcy management, loan documentation, regulations and company policies.

Responsibilities

Bankruptcy Account Management

  • Manage and monitor bankruptcy accounts, ensuring all actions comply with bankruptcy laws and regulations.
  • Responsible for coding, documenting, and monitoring bankruptcy accounts. Send correspondence to members, attorneys, the Bankruptcy Court, and Trustees, as well as other bankruptcy account assistance as necessary.
  • Maintain accurate and up-to-date records of all bankruptcy accounts and related documentation.

 

Legal Documentation & Filing

  • Prepare and file necessary legal documents for bankruptcy cases, including proofs of claim and reaffirmation agreements.
  • Ensure all bankruptcy processes adhere to federal and state regulations, as well as credit union policies, and procedures.
  • Documenting and updating information for all bankruptcy accounts to ensure accuracy and compliance with legal standards.

 

Communication & Collaboration

  • Serve as the primary point of contact for bankruptcy Trustees, attorneys, and courts.
  • Communicate with members regarding their bankruptcy status and provide information on available options.
  • Collaborate with external legal counsel as needed to handle complex bankruptcy cases.
  • Provide guidance and support to the collections team on bankruptcy-related matters.
  • Maintain professional communication, diplomacy, and accuracy in all interactions with members, associates and external stakeholders.

 

Compliance & Policy Development

  • Actively track and analyze updates to bankruptcy laws and regulations, implementing necessary adjustments to maintain compliance and reduce legal exposure.
  • Assist in the development and implementation of policies and procedures related to bankruptcy management.
  • Performs all other duties as assigned, ensuring accountability and alignment with organizational objectives.

Qualifications

  • Bachelor’s degree in Legal Studies, Business Administration, or a related field preferred or a minimum of 3 – 5 years of experience in bankruptcy management or a related legal role, preferably within a financial services or.
  • Thorough knowledge of bankruptcy laws and regulations, court procedures, and compliance standards, with a track record of successful case management.
  • Comprehensive understanding of legal processes, Consumer Financial Protection Bureau (CFPB) and Fair Debt Collection Practices Act (FDCPA). Uniform Commercial Code (UCC) regulations, compliance requirements, as well as credit union policies and procedures.
  • Proficiency in Microsoft Office Suite (Excel, Word, Outlook) with the ability to utilize advanced functions for data management, document creation, and communication. Microsoft Office Suite (Excel, Word, Outlook).
  • Proven ability to communicate effectively, negotiate successfully, and resolve problems while maintaining empathy and confidentiality in sensitive situations.
  • Strong organizational skills, attention to detail, and ability to manage multiple tasks simultaneously.

  • Professional appearance, punctuality, and a cooperative attitude towards colleagues and members.
